PRAYER:

Writ petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus to direct the 1st and 2nd respondent to dispose of the representations given by the petitioner dated 12.04.2017 and 17.04.2017 respectively and direct the respondents to pass orders in relation to obtaining of licence by the 3rd respondent. For Petitioner : M/s.Srenik S Jain For Respondents : Mr.T.C.Gopalakrishnan, (for RR1 & 2) Notice Dispensed with (for R3)

ORDER

Mr.T.C.Gopalakrishnan, learned Standing Counsel takes notice for the respondents 1 & 2. Considering the prayer sought for in this Writ Petition, notice to the 3rd respondent is dispensed with.

2. The grievance of the petitioner is that the 3rd respondent, who is a tenant under him, without getting licence from the Corporation is running a furniture shop. Despite the representation to the respondents 1 and 2, no action was taken. Hence, the present Writ Petition.

3. The learned Standing Counsel for the respondents 1 & 2 submitted that the 2nd respondent, who is the competent authority, is ready to consider the representation of the petitioner and pass appropriate orders, after providing an opportunity of hearing to the petitioner as well as the 3rd respondent.

4. In the light of the above submissions and the prayer sought for in this Writ Petition, this Court, without going into the merits of the case, directs the 2nd respondent to consider the representations of the petitioner dated 12.04.2017 and 17.04.2017 and pass appropriate orders on merits and in accordance with law, after providing an opportunity of hearing to the petitioner as well as the 3rd respondent, within a period of twelve weeks from the date of receipt of a copy of this order.

5. With the above direction, the Writ Petition is disposed of. No costs.
