And order IV Rule 1 of O.S.Rules r/w Section 20(3) of the Specific Relief Act, 1963 praying for judgment and decree as follows:

(a) Granting a mandatory injunction directing the Defendant to execute the Project, i.e., work of design, supply and installation of modular accommodation space of naval ship of Indian navy under the tender of the Cochin Shipyard Limited, jointly in partnership with the Plaintiff in respect of the agreed scope of work of the Plaintiff as per the Schedule; (b) a permanent injunction restraining the Defendant, its director, officers, servants, agents, representatives and person or persons claiming through or under it from executing the project, i.e., work of design, supply and installation of modular accommodation space of naval ship of Indian navy under the tender of the Cochin https://hcservices.ecourts.gov.in/hcservices/ Shipyard Limited, except jointly and in partnership and

JUDGMENT

The learned counsel for the plaintiff has filed a memo, stating that the suit may be dismissed as settled out of Court and he has also made an endorsement to that effect.

2. In view of the endorsement made by the learned counsel for the plaintiff, the Civil Suit is dismissed as settled out of Court. The Registry is directed to refund half of the Court fee No costs.
