ORDER : The Court Made the following order :- The petitioner herein, who is the brother of the first accused, is absconding. The case of the prosecution is that the petitioner and the brother of the petitioner herein allured the defacto complainant and promised to get a job in the Government. On 02.02.2018, the defacto complainant had acted as an agent and gave Rs.1,07,50,000/- to Swaminathan, Sivaraman, Girish krinal, Deepak, Harendrapradap Singh and Sathyanathan. He, on behalf of the other persons, demanded money back. Since they were not able to arrange the Government job, he was threatened.

2.This Court on going through the contents of the F.I.R. finds that the defacto complainant has acted as an agent for the accused persons and has collected money from 13 persons to the tune of 1,07,50,000/- and thereafter, the accused persons has produced some fake order copy in the name of the Northern Railway and took all the persons to Lucknow and arranged for stay in a hotel at Lucknow and thereafter, took them to the Northern Railway Police Workshop at https://hcservices.ecourts.gov.in/hcservices/

Lucknow and made them to believe that their appointment order is genuine and they will be asked to join duty soon. Narration of events as found in the F.I.R. clearly shows that the job racket scam has been well organised by the accused person in connivance with the defacto complainant and the defacto complainant, who collected money as agent, having been pressurized from the persons, has been arrested by way of complaint.

3.This Court while dismissing the petition for bail on the ground that the investigation has to be done without hindrance and distortion and the release of this petitioner will cause hindrance to the investigation, the respondent police is directed to secure the defacto complainant, Keerthi Vasan, who on his own words and statement has disclosed that he had acted as an agent and received from the others and given to the accused person on various dates and also to make appropriate investigation regarding involvement of these persons regarding fabrication of fake appointment order copy. -sd/- 01/04/2022 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
