This Court, vide order dated 5.8.21 directed the respondent to file a status report, which was filed and not being satisfied with the said report, further report was directed to be filed by the Secretary, Food and Consumer Protection Department and Secretary, Public Health and Family Welfare Department, Government of Tamil Nadu.

2. Today, when the matter is taken up, Mr.Hasan Mohamed Jinnah, learned Public Prosecutor, assisted by Mr. A.Gopinath, Government Advocate (Crl. Side) produced before this Court the Additional Status Report filed by the Commissioner of Food Safety (FAC), Chennai with reference to the queries raised by this Court.

3. A perusal of the said report reveals that steps have been taken by the concerned authorities for filling up of the vacancies to the post of Food Safety Officer and Lab Technician Grade-II. It is further evident from the said report that necessary notification for recruitment for the post of Food Safety Officer and Lab 1/4

Technician Grade-II has been approved by the Government and G.O. (D) No.975, Health and Family Welfare (M1) Department dated 27.8.21 and G.O. Ms. No.1099, Health and Family Welfare (M1) Department dated 4.10.21 have been issued and consequent to the same Notification No.02/MRB/2021 dated 28.09.2021 and Notification No.02/MRB/2021 dated 12.10.2021 for direct recruitment to 119 vacant posts of Food Safety Officers and steps are also being taken for filling up the 19 vacant posts of Lab Technician Grade-II and notification in this regard is to be published shortly. Therefore, it is prayed that this Court may be pleased to accept the additional status report and pass further orders.

In view of the fact that steps, as noted above, has been taken by the concerned authorities and requisite Government Orders and notifications for filling up the posts of Food Safety Officers and Lab Technicians Grade-II have been issued/set in motion, this Court is inclined to accept the said report and, accordingly, the report dated 20.10.2021 filed by the Commissioner of Food Safety is accepted.

5. No further orders are required to be passed in the petition. This Court earnestly hopes and trusts that the above posts would be filled up at the earliest as submitted before this Court in the aforesaid additional status report. 21.10.2021 GLN 3/4
