This petition has been filed to modify the condition imposed on the petitioner is directed to deposit a sum of Rs.75,000/- (Rupees seventy five thousand only) as non-refundable deposit to the credit of Crime No. within a period of two weeks in the above Crl.O.P.No.4005 of 2023 dated 27.02.2023.

2. The learned counsel for the petitioner submitted that as he is coming from poor family and daily wages coolie, he is not able to mobilise the amount to deposit to the credit of crime number as directed by this court. Hence, the present petition has been filed to modify the condition.

3. Considering the facts and circumstances and also considering the reasons stated by the petitioner in the petition seems to be justifiable, this Court is inclined to modify the condition that the 1/3

petitioner shall deposit the sum of Rs.50,000/- (Rupees fifty thousand only) to the credit of Crime No.556 of 2021 before the concerned Magistrate within a period of two weeks from the date of receipt of copy of this order.

4. Except the above modification, the other conditions imposed by this Court in Crl.O.P. No. 4005 of 2023 vide order dated 27.02.2023 shall remain unalterted.

5. Time is extended for further period of two weeks for execution of sureties from the date of receipt of copy of this order. 17.03.2023 rpp 2/3
