ORDER

The petitioner / accused in Cr.No.425/2025 registered for the offences under Section 296(b) and 118(1) of BNS, has filed this quash petition.

2. The learned counsel for the petitioners submitted that the second petitioner is working as an Assistant Professor and is pursuing Ph.D and also preparing for the Government Examinations. The de facto complainant had an altercation with the first petitioner and attacked the first petitioner with stone and due to severe pain the first petitioner called the second petitioner for help and the petitioners 3 and 4 tried to stop the fight. Later the first and second petitioners lodged a case against the second respondent in Cr.No.424/2025 for the offences under Section 294(b), 118(1) of BNS. Thereafter, the second

respondent colluded with the first respondent, had given a false complaint against the petitioners 1 to 4 in Cr.No.435/2025. Hence, he prays for quash.

3. The learned Additional Public Prosecutor had filed a counter and in which it is stated as under:

"On 26.12.2025, when Tr.K. Balamurugan, Sub-Inspector of Police, was on station duty at Jolarpet received from the Police Station, intimation was an Government Hospital, Tirupattur. Upon receiving the said intimation, proceeded to the Government Hospital, Tirupattur, with enquired where Purushothaman, aged about 45 years, the inpatient son of Puttan, residing at No. 1/111, V.M. Circle, Ammaiyappan Nagar, Jolarpet, Tirupattur District. After enquiry, his statement and, based on the same, returned to the police station and registered a case on 28.12.2025 at about 12.30 p.m.

It is statement, respectfully submit the said Purushothaman that, in his stated that he resides at the above address along with his mother Kamala, aged about 80 years, and that he is employed with Zomato. He further stated that he is married but is presently living separately from his wife. On 26.12.2025 at about 09.00 a.m., when he came out of his house, he noticed that sanitary waste (Stayfree napkins) had been discarded on the road. At that time, certain Panchayat workers were collecting garbage and attempted to burn the waste along with the said sanitary waste. When he objected and told them not to light the fire as it might damage the tamarind tree near his house, Renuka Devi/A-lwho was present there, abused him in filthy language and made derogatory remarks about him and his wife.

4. It is respectfully submit that, Parvathi/A-2, the daughter-in-law of Renuka Devi, caught hold of his shirt, pulled him, and slapped him on his right cheek. Subsequently, they also assaulted him on his back and hands

with a stick belonging to his mother. Further, Venkatesan/A-3 and Lakshmanan/A-4, who came there under the pretext of separating them, also caught hold of him the complainant attempted to and assaulted him. When record the incident on his mobile phone, the accused persons snatched the phone from him. Thereafter, complainant managed to retrieve the phone and went to the Government Hospital, Tirupattur, wheeler, where the doctor provided admitted him as an inpatient. The on his two-treatment and

It is respectfully submitted that, based on the complaint, a case was registered in Jolarpet Police Station, Crime No.425 of 2025, u/s.296(b), 118 (1) BNS against the accused on 28.12.2025 at about 12.30 hours by Tr.K.Balamurugan, the then Sub Inspector of Police and submitted before me for investigation."

3.1 He further submitted that it is the case in counter and on the petitioner's complaint, a case in Cr.No.424/2025, has been registered which is pending investigation. Both the cases are being investigated by following the Police Standing Order 566 and on conclusion of investigation, final report will be filed by following the Standing Orders and the decision of the Full Bench of this Court in T.Balaji and another Vs. The State rep. by the Inspector of Police and another in Crl.O.P.Nos.4587/2024 & batch dated 08.08.2024.

4. Recording the submission of the learned Additional Public Prosecutor, this Criminal Original Petition is dismissed. Connected miscellaneous petition is closed.
