O R D E R

This revision has been filed by the petitioner to set aside the judgment and conviction dated 20.04.2011 made in C.A. No. 26 of 2010 on the file of the Additional District and Sessions Judge, Fast Track Court, Namakkal confirming the judgement and conviction and partly modifying the sentence as imposed by the learned Judicial Magistrate No.2, Namakkal in a judgment dated 23.03.2010 made in STC.No. 633 of 2007.

2. Today, when the matter is taken up for hearing Mr.T.Munirathnam Naidu, learned counsel appearing for the petitioner as well as Mr.C.Prakasam, learned counsel appearing for the respondent are present.

3. The learned counsels appearing for either side have submitted that the dispute between the petitioner and the respondent has been settled by way of settling a sum of Rs.2,50,000/- in full quit to the respondent and also filed a Joint Memo of Compromise dated 24.04.2018 before this Court today.

The learned counsel appearing for the revision petitioner has handed over the Demand Draft in D.D. No. 659291 for Rs.2,50,000/- (Rupees Two Lakhs and Fifty Thousand Only) drawn on Canara Bank, Mohanur infavour of the respondent namely Nirmala to the learned counsel appearing for the respondent.

4. Recording the same, the judgment and conviction passed by the learned Judicial Magistrate No.2, Namakkal by judgment dated 23.03.2010 made in STC.No. 633 of 2007 as confirmed and partly modified by the learned Additional District and Sessions Judge, Fast Track Court, Namakkal in Crl.Appl. No. 26 of 2010 dated 20.04.2011 are set aside and the petitioner is acquitted.

5. Accordingly, the Criminal Revision Petition stands disposed of. The Joint Memo of Compromise dated 24.04.2018 shall form part of the order.
