ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences under Sections 4(1)(a), 4 (1)(i) of Tamil Nadu Prohibition Act r/w 24 Tamil Nadu Prohibition Act, in Crime No.56 of 2022 seeks anticipatory bail.
2. The case of the prosecution is that the petitioners herein are arrayed as A3 and A4. Totally 127 bottles of IMFL was secured from the accused A1 and from the confession statement of A1, these petitioners are implicated in this case. Hence the complaint.
3. The learned counsel for the petitioner submits that A1 was former employee under A3/bar owner and due to animosity, he has implicated the petitioners. Hence, he prays for grant of anticipatory bail to the petitioners.
4. The learned Government Advocate (Crl.Side) submits that the first petitioner herein is the bar owner and the second petitioner is the supervisor of the bar and they were diverted the liquor https://hcservices.ecourts.gov.in/hcservices/
bottles through other accused to be sold during the prohibited hours. Hence, he opposed for the grant of anticipatory bail to the petitioners.
5. Considering the fact that the IMFL which was seized was rooted through these petitioners, this Court is not inclined to grant anticipatory bail to the petitioners.
