This petition is filed to punish the respondent for his willful disobedience of the order dated 05.01.2023, passed in C.R.P.No.4381 of

2022.

2.Based on the undertaken given by the respondent, C.R.P.No.4381 of 2022 was disposed of. Since the respondent has not vacated the premises, the contempt petition came to be instituted. Now, it is brought to the notice of this Court that the respondent had vacated the premises and handed over. However, the learned counsel for the petitioner would submit that the arrears of rent is yet to be paid by the tenant. In this regard, an adjudication is required to determine the quantum of rent, which is to be settled in favour of the landlord. Thus, the petitioner is at liberty to move before the competent Court for the purpose of recovery of rent in the manner known to law.
