This petition is filed under Article 226 of the Constitution of India, seeking writ of mandamus, directing the Respondents to consider and dispose of the petitioner's representations dated 22.10.2025, 26.11.2025 and 11.02.2026 with regard to payment of subsistence allowance during suspension period from 11.08.2023 and to cancel the enquiry report and order a fresh enquiry into the charges framed against

the petitioner by charge memo dated 01.07.2024 and to disburse the subsistence allowance equivalent to full pay of the petitioner. For Petitioner(s):

ORDER

This writ petition is filed for the following relief: "To direct the Respondents to consider and dispose of the petitioner's representations dated 22.10.2025, 26.11.2025 and 11.02.2026 with regard to payment of subsistence allowance during suspension period from 11.08.2023 and to cancel the enquiry report and order a fresh enquiry into the charges framed against the petitioner by charge memo dated 01.07.2024 and to disburse the subsistence allowance equivalent to full pay of the petitioner."

2. The petitioner was working as a Secretary in the Industrial Employees Cooperative Society Ltd., While he was working as a Secretary, he was placed under suspension on 11.08.2023 and after a lapse of one year a charge memo was issued on 01.07.2024 by the 3rd respondent.

3. The petitioner would submit that he was not paid the subsistence allowance during the suspended period. Further, the Enquiry Officer has filed an enquiry report without his explanation to the charges framed. Therefore, in this regard the petitioner made representations on 22.10.2025, 26.11.2025, 10.12.2025 and 11.02.2026 to the respondents. However, there is no response from the respondents. Therefore, the petitioner is before this Court.

4. Considering the facts and circumstances of the case and the fact that the petitioner's representations have not been considered to date, a direction is issued to the respondents to consider the petitioner's representation dated 11.02.2026 and pass orders on its own merits within a period of 3 months from the date of receipt of a copy of this order.

5. With the above direction, this writ petition is disposed of. No costs.
