Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, for the issuance of Writ of Mandamus directing the third respondent to provide the police protection at that time of surveying, fencing around the petitioner's housing plot in Survey No.151/2A7C at 1/4

measuring about 3060 sq.ft in Plot No.83 situated in Immanuel Garden, Mangalam, Thirukkazhukundram, Chengalpattu District based on the petitioner's representation dated 15.10.2024. For Petitioner : Mr.A.Venkatesan For Respondents : Mr.A.Gopinath, Government Advocate (Crl.Side) for R1 to R3

O R D E R

This petition has been filed directing the third respondent to provide the police protection at that time of surveying, fencing around the petitioner's housing plot comprised in Survey No.151/2A7C to an extent of 3060 sq.ft situated at Plot No.83 situated in Immanuel Garden, Mangalam, Thirukkazhukundram, Chengalpattu District based on the petitioner's representation dated 15.10.2024.

2. The gist of the case is that in order to fence the petitioner's property, he has submitted an application before the revenue authorities to survey the subject property. He had also paid the requisite court fee. When the Surveyor about to survey the subject property, the respondents 2/4

4 and 3 were obstructing the Surveyor to survey the subject property. Hence the present petition.

3. In view of the above, if the Surveyor finds any hindrance or obstructions at the hands of the respondents 4 and 5, the Surveyor can very well seek for police protection before the third respondent and on receipt of such requests, the third respondent is directed to conduct enquiry and pass appropriate order to provide adequate police protection to the Surveyor while surveying the subject property.

4. With the above direction, this writ petition is disposed of. No costs.
