Application No.5222 of 2016 in C.S.No.90 of 1963 M.JAICHANDREN,J., This application has been filed by the Official Trustee of Tamil Nadu to grant permission to utilize the surplus money in the Trust Estate of Rajah Sir Ramasamy Mudaliar Charities, for the purpose of purchasing Breast Pump and other accessories for the Rajah Sir Ramasamy Mudaliar Hospital at the cost of Rs.12,90,000/- [Rupees twelve lakhs and ninety thousand only].

2. Heard the learned Official Trustee of Tamil Nadu appearing on behalf of the applicant.

The learned Official Trustee had stated in his report that the administration of 'The Rajah Sir Ramaswami Mudaliar's Choultry' and its allied endowment are governed by a decree, dated 18.08.1970, passed by this Court, in C.S.No.90 of 1963. Further, the management of the Choultry and its allied charities have been vested with the Official Trustee of Tamil Nadu.

4. It is further stated in the report of the Superintendent of Rajah Sir Ramasamy Mudaliar Hospital had requested the Official Trustee of Tamil Nadu to sponsor Breast Pump Machines and other accessories. In this regard, the Superintendent of Rajah Sir

Ramasamy Mudaliar Hospital had obtained three quotations from various companies and the same were submitted to the office of the Administrator General and Official Trustee of Tamil Nadu. Among the three quotations, Walnut Corporation had quoted the lowest price. It is further stated that the Superintendent of Rajah Sir Ramasamy Mudaliar Hospital had recommended for the acceptance of the quotation of Walnut Corporation. Accordingly, the Official Trustee is seeking permission to utilize the surplus money of the Trust estate of Rajah Sir Ramasamy Mudaliar, for the purpose of purchasing Breast Feeding Machines and allied instruments.

5. This Court had perused the records.

6. At the time of the hearing of this application, Dr.Anitha and Dr.Arvind attached to the Rajah Sir Ramasamy Mudaliar Hospital were present and they had explained the utility of the Breast Feeding Machines sought to be purchased.

7. As the predominant object of the trust is for the feeding of the poor, this Court is of the view that this application taken out up by the Official Trustee for the sponsoring of the Breast Feeding Machines and other allied accessories falls within the ambit of the objects of the Trust.

In view of the submissions made by the Official Trustee and the Doctors of the Rajah Sir Ramasamy Mudaliar Hospital, this Court is inclined to grant permission to the Official Trustee of Tamil Nadu, to utilize the surplus money in the Trust Estate of Rajah Sir Ramasamy Mudaliar Charities for the purpose of purchasing the Breast Pump and other accessories for the Rajah Sir Ramasamy Mudaliar Hospital at the cost of Rs.12,90,000/- [Rupees twelve lakhs and ninety thousand only].
