Mr.P.Dhileepan Government Advocate (Crl.Side) COMMON ORDER The petitioners in Crl.O.P.No.5228 of 2026, who apprehend arrest at the hands of the 1st respondent police for alleged offences punishable under Section 3(5), 316(2), 318(4), 336(3), 338, 340(2), 61(2) of BNS in Crime No.0037 of 2026 on the file of the respondent police, seeks anticipatory bail. The petitioners in Crl.O.P.No.6663 of 2026, who apprehend arrest at the hands of the 1st respondent police for alleged offences punishable under Section 3(5), 351(2), 115(2), 61(2), 323, 318(4), 317(4), 316(2), 314 and 309(4) of

BNS in Crime No.0004 of 2026 on the file of the respondent police, seeks anticipatory.

bail.

The petitioners in Crl.O.P.No.6665 of 2026, who apprehend arrest at the hands of the 1st respondent police for alleged offences punishable under Section 3(5), 61(2), 340(2), 338, 318(4) and 316(2) of BNS in Crime No.0053 of 2026 on the file of the respondent police, seeks anticipatory bail.

2. The present applications have been filed seeking inter-state anticipatory bail.

3. The main ground urged by the petitioners is that they were incapacitated from immediately approaching the jurisdictional Court on medical grounds. In this regard, the petitioners have submitted medical certificates. It is further submitted that that a false complaint has been lodged against them and that they have no connection with the alleged offences. The learned counsel also contended that interstate anticipatory bail may be granted to enable the petitioner to approach the appropriate jurisdictional Court for necessary relief.

4. This Court is not inclined to accept the medical certificates produced by the petitioners. Further, this Court is unable to find any extraordinary

circumstances that prevented the petitioners from approaching the Jurisdictional Court.

5. It is a well-settled principle of law that inter-state anticipatory bail is an exception and cannot be treated as a rule. Even according to the factual position, the petitioners had participated in the business dealings of the defacto complainant, entered into contractual arrangements, and the present dispute appears to have arisen out of such transactions. Therefore, the petitioners have a clear nexus and connection in Mumbai and have business dealings in the state of Maharashtra.

6. In such circumstances, this Court does not find any exceptional grounds to invoke its jurisdiction to grant inter-state anticipatory bail as a matter of routine. Hence, this Court finds no merit in these petitions. Accordingly, these criminal original petitions are dismissed. 24-03-2026 MPA
