Order
(1) The petitioner has purchased the property measuring an extent of 600 sq.ft., in TS.No.28/2, Nallur Village, Block 49, Thennampalayam Extension RVE Layout, Tiruppur South Taluk, Tiruppur District, by virtue of a registered Sale Deed dated 04.12.2024, from the 3rd respondent herein. The petitioner states that his vendor, the 3rd respondent herein, purchased the property in an auction sale, vide Sale Certificate dated 24.01.2019, registered in the office of the Joint Sub Registrar-II, Tiruppur, on 22.04.2019, in Doc.No.2135/2019. The petitioner further states that he is the bona fide purchaser for value and after purchase, he mutated the Town Survey Land Register and tax assessments in his favour. The petitioner states that while so, without impleading the
petitioner as a party, the 1st respondent herein, suppressing all the facts, filed EA.No.6/2025 in EP.No.13/2025, to set aside the exparte order dated 22.08.2022 in EA.No.55/2019. The Trial Court, without considering the facts and law, passed the impugned order, setting aside the Court auction sale conducted on 08.06.2018. The petitioner states that he became the absolute owner of the property as early as in the year 2024, whereas the application was filed in 2025, without impleading the petitioner as a party. The petitioner states that he is aggrieved by the order of the Trial Court dated 07.01.2026, made in EA.No.6/2025, and hence, as a a third party to the proceedings, he has sought leave to this Court to file the above Civil Revision Petition.
(2) From the perusal of the order dated 07.01.2026, in EA.No.6/2025, it is clear that the petitioner was not a party to the proceedings and therefore, this Court, being satisfied with the averments made in the affidavit filed in support of the petition, is inclined to grant leave to the petitioner.
