JUDGMENT

The criminal appeal has been filed against the judgment dated 18.09.2009 made in S.C.No.54 of 2009 on the file of the First Additional District and Sessions Judge at Coimbatore.

2. Today, when the appeal is taken up for hearing, the learned Government Advocate filed memo stating that the appellant in this appeal died on 27.01.2011 and he enclosed a copy of the death certificate issued by the Village Administrative Officer, Udumalpet.

3. Initially, the appeal has been preferred against the judgement dated 18.09.2009, passed by the learned First Additional District and Sessions Judge, Coimbatore in S.C.No.54 of 2009, in which the appellant was convicted and sentenced to https://hcservices.ecourts.gov.in/hcservices/

undergo ten years Rigorous imprisonment and pay a fine of Rs.5,000/- i/d to undergo three years Simple imprisonment.

4. Under such circumstances, since the appellant himself died, the appeal become abated. Accordingly, the criminal appeal is dismissed as abated.
