ORDER
The petitioners are before this Court being aggrieved by the action of the 1st respondent dated 11.02.2021, wherein the 1st respondent has requested the 2nd respondent for conduct of enquiry in regard to the tenancy right claimed by the petitioners. By the impugned communication, the 2nd respondent was requested to submit a report in regard to the claim of the petitioners and this Court is unable to appreciate as to how the petitioners can claim themselves to be aggrieved by such action. https://hcservices.ecourts.gov.in/hcservices/
2. In the matter like the present one, the petitioners claim could be considered and established after the report is obtained from the 2nd respondent and in any event, at present, the petitioners have no cause of action to approach this Court. The writ petition appears to be too premature and there is no cause of action for the petitioners to invoke the extraordinary jurisdiction under Article 226 of the Constitution of India at the moment.
3. In fact, the affidavit contains several disjointed facts which cannot be a subject matter of adjudication by this Court under Article 226 of the Constitution of India. In any case, the petitioners cannot be construed to be aggrieved by the impugned action for the present. This Court is not inclined to entertain the writ petition. Therefore, the Writ Petition stands dismissed. No costs. Consequently, connected miscellaneous petitions are closed.
