Both parties are present. The learned counsel for the petitioner M/s.A.E.Lakshmi Narayanan and the respondent appeared party-inperson are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:
ORDER
Both parties are present. The appellant /accused has preferred the present Criminal Revision against the order passed C.A.No.3 of 2015, dated 20.09.2015 on the file of the Principal Sessions Judge, Tiruvallur, confirming the judgement in STC No.132 of 2014, dated 17.12.2014 on the file of FTC Magistrate, Ambattur.
2. The claims relates to cheque amount of Rs.2,00,000/-. Now the parties have entered into the settlement as on Rs.2,00,000/- from the appellant. The respondent is willing to compromise the matter (endorsement made by the respondent in the court bundle).
3. The respondent admitted having received a sum of Rs.1,50,000/- earlier and by virtue of conditional order passed by High Court of Madras. The appellant had deposited a sum of Rs.50,000/- in the Trial Court on 02.11.2015, (Receipt No.1350515).
4. The respondent/complainant is entitled to withdraw the amount of Rs.50,000/- which was deposited before the FTC Magistrate, Ambattur. The respondent has appeared party-inperson and produced her voter ID card and her husband also produced the driving license.
5. Under the circumstance the compromise entered into between the parties are recorded and conviction and sentence imposed passed against the revision petitioner is setaside. The full Court fee paid shall be refunded to the appellant in the manner provided under Section 69-A of the Tamil Nadu Court-Fees and Suits Valuation Act, 1955 and the Court Fees Act,
1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act 1987 as amended in 1994.
