(The case has been heard through video conference) This Writ Petition has been filed seeking a direction directing the 2nd respondent to rectify the mistake/oversight pertaining to the interim compensation amount and date paid to the petitioner in connection with L.A.O.P.No.77 of 2017 on the file of Subordinate Court, Ponneri reflecting in Permanent Account Number AYCPR7915H of the petitioner.
2. The grievance of the petitioner is that, earlier, the petitioner's land along with some others lands were acquired by the 1st respondent and an interim compensation was also paid. So far as the petitioner's land is concerned, he was awarded a compensation of Rs.51,93,592/-, and the above said amount has been paid to the petitioner. However, while filing T.D.S. Form before the income tax authority, the 1st respondent has wrongly mentioned award amount paid to the petitioner as Rs.86,55,987/- as if the above amount has been paid to the petitioner. Hence, to rectify the said mistake, the present Writ Petition has been filed.
3. Today, when the matter was taken up for hearing, Mr.D.Raja, learned Additional Government Pleader appearing for respondents, on instructions, would submit that, now the above said mistake has been rectified, and the 1st respondent has sent correct particulars to the income tax department and the income tax department has also carried out necessary correction in the records.
4. Recording the above submissions, as the mistake has been rectified, no further adjudication is required in this Writ Petition. Accordingly, this Writ Petition stands closed. No costs. Consequently, the connected Writ Miscellaneous Petition is closed.
