ORDER

This writ petition has been filed to direct the first respondent to recall the objection letter dated 10.04.2024, based on the petitioner's representation dated 23.10.2024.

2. According to the petitioner, he proposes to present the Sale Deed for the property morefully described in the prayer of this writ petition for registration with the third respondent. According to the petitioner, he has been informed by the third respondent that an objection has been raised by the first respondent, through their letter dated 10.04.2024 that the third respondent should not register any document pertaining to the very same property for registration. The petitioner seeks for recall of the said objection letter through this writ petition.

3. Mr. V. Meganathan, learned Government Advocate (Crl. Side) accepts notice on behalf of the respondents 1 and 2 and Ms. Aswini Devi K, learned Additional Government Pleader accepts notice on behalf of the third respondent.

4. The learned Additional Government Pleader appearing for the third respondent, on instructions, would submit that till date, no document has been presented by the petitioner for registration. She also submits that only if a document is presented for registration, the third respondent will be in a position

to take a decision as to whether the said document can be registered or not.

5. This Court is not expressing any opinion on the merits of the objections raised by the first respondent through their objection letter dated 10.04.2024.

6. No prejudice would be caused to any of the parties if the petitioner is allowed to present the Sale Deed for registration with the third respondent and after hearing their objections, take a final decision on merits and in accordance with law as to whether the Sale Deed can be registered or not.

7. Accordingly, this writ petition is disposed of by directing the petitioner to present the Sale Deed for registration with the third respondent within a period of one week from the date of receipt of a copy of this order. On presentation of the said sale deed, the third respondent, after issuing notice to all the necessary parties, including the first respondent, and after hearing their objections, shall take a final decision on merits and in accordance with law, after giving due consideration to the contentions of the petitioner as well as the supporting documents produced by the petitioner, as to whether the Sale Deed presented by the petitioner can be registered or not, within a period of four weeks thereafter.

8. In case, the third respondent decides to refuse registration of the sale deed to be presented by the petitioner, the third respondent shall pass a speaking order, after giving due consideration to the contentions of the petitioner as well
