ORDER
The petitioner, on whose complaint a case in Crime No.1325 of 2018 has been registered by the respondent Police on 24.11.2018, for the offences under Sections 406 and 420 IPC, has filed the present Criminal Original Petition to direct the respondent Police to file a final report within a stipulated time frame.
2.The case of the petitioner/complainant is that one Panneerselvam, having office in the name and style of RI Traders, Arumbakkam, Chennai, had procured cashew nuts from the petitioner to the tune of Rs.15,00,000/- and has failed to settle the dues. When demanded, he threatened the petitioner of dire consequences. Hence, the complaint.
3.It is the contention of the petitioner that, after registration of the FIR, no proper investigation is being conducted and nothing is moving forward and the petitioner is also not being informed about the stage of the investigation despite the petitioner appeared before the respondent Police and sought for clarification. Hence, the petitioner has filed this Criminal Original Petition to direct the respondent Police to complete the investigation and file a final report in Crime No.1325 of 2018.
4.Learned Government Counsel (Criminal Side) appearing for the respondent Police submitted that, in this case, investigation was conducted and witnesses were examined and listed. In the meanwhile, it was informed that the accused Panneerselvam died due to heart attack on 11.10.2020 and hence, the charge abates. The closure report in Crime No.1325 of 2018 has also been filed before the jurisdictional Magistrate Court through e-filing No.LTN20230002402C202600021 on 01.04.2026.
