ORDER

(Order of the Court was made by SATISH K. AGNIHOTRI, J.) With the consent of the learned counsel for the parties, the writ petition is taken up for final disposal. Being aggrieved by the non-issuance of social status / community certificate pursuant to Proceedings No.9280/CVIII/2014 dated 04.02.2015 of the State Level Scrutiny Committee, by which it was confirmed that the petitioners' son by name P. Kumar belongs to Kurumans (ST) community, the petitioners have filed the instant writ petition seeking a direction to the respondent to issue social status/community certificate to them, based on the application dated 08.03.2015 made by their son to this effect, at the earliest. https://hcservices.ecourts.gov.in/hcservices/

Concededly, the status of the petitioners' son by name P.Kumar that he belongs to Kurumans (ST) community has been confirmed by the State Level Scrutiny Committee vide Proceedings No.9280/CVIII/2014 dated 04.02.2015. Thus being the position, as a natural corollary, the petitioners, who are parents of the said P. Kumar, are entitled to get the community certificate that they belong to Kurumans (ST) community.

In such view of the matter, the respondent/authority is under an obligation to consider the application dated 08.03.2015 made by the petitioners' son P.Kumar, seeking issuance of community certificate to his parents, in the light of the community certificate/social status certificate issued to him. The community certificate issued in favour of the petitioners' son P. Kumar is an important document for consideration to grant community certificate to the petitioners who are his parents, as required for issuance of community/social status certificate.

In the light of the aforestated, the competent authority is directed to re-consider the application dated 08.03.2015, after proper enquiry and issue a proper social status/community certificate to the petitioners, within a period of four weeks from the date of receipt of a copy of this order.

With the above direction, this writ petition is disposed of. No costs.
