ORDER

Challenging the impugned order passed by the trial Judge in IA.No.1 of 2025 in HMOP.No.2706 of 2024, on the file of the V Additional Family Court,

Chennai, granting interim maintenance, the husband has preferred this revision.

2. The learned counsel for the revision petitioner submitted that the petitioner is unemployed and has no source of income, and that he has to take care of his parents. Without considering his financial condition, the trial Court has ordered payment of Rs. 7,500/- to the wife and child, which is excessive. Hence, he prayed for modification.

3. On perusal of the records, it is seen that the wife and child are living together, and there is no proof that the wife has sufficient independent income. Therefore, the trial Court's order directing payment of Rs. 7,500/- is justified.

4. However, it is also contended that the petitioner has no permanent employment. The trial Court observed that he earns Rs. 15,000/- per month. It is also submitted that the wife is employed in a private textile showroom.

5. Considering these aspects, this Court modifies the maintenance amount from Rs. 7,500/- to Rs. 6,500/-. The petitioner is directed to pay the said amount from the date of the petition along with accrued arrears within 12 weeks.
