O R D E R

The petitioner, who was arrested and remanded to judicial custody on 07.12.2023, for the offence punishable under Sections 8(c) r/w 20(b)(ii)(c), 25 1/4

and 29(i) of NDPS Act in Crime No.845 of 2023, registered on the file of the respondent police, seeks bail.

2. The learned counsel appearing for the petitioner submits that this is the fourth bail petition filed by the accused in connection with the recovery of 54 kgs of ganja. Since the contraband seized is of commercial quantity, this Court on earlier occasions, found that the bar under Section 37 of the NDPS Act squarely attracts and dismissed the bail petitions.

3. The learned Government Advocate (Crl.Side) appearing for the respondent submits that after filing of the charge sheet, the case has now been posted for examination of prosecution witnesses. If the petitioner is enlarge on bail, there is every possibility of his absconding and thereby delaying the trial.

4. Considering the facts of the case and circumstances of the case, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
