ORDER

This writ petition has been filed to direct respondents 1 to 3 not to survey and demarcate the boundaries of the property, morefully described in the prayer to this writ petition since a Civil Suit in O.S. No.106 of 2025 is pending. 2.The petitioner had raised all his objections through his representation dated 23.02.2026 submitted to respondents 1 to 3. The grievance of the petitioner in this writ petition is that without considering the petitioner's objections, respondents 1 to 3 are attempting to complete survey and demarcation of the boundaries of the property. Pursuant to the earlier directions given by this Court, on a request made by private respondents i.e. 4 and 5, respondents 1 to 3 are proceeding to survey and demarcate the boundaries of the property.

However, necessarily, the objections raised by the petitioner through his representation dated 23.02.2026 have to be considered by respondents 1 to 3 before completing survey and demarcation of the boundaries of the property. 3.Mr.S.Arumugam, learned Government Advocate accepts notice on behalf of respondents 1 to 3.

respondents 4 and 5, notice to respondents 4 and 5 is dispensed with by this Court.

4.It is brought to the notice of this court by the learned Government Advocate appearing for respondents 1 to 3 on instructions that the survey and demarcation of the boundaries is yet to be completed by respondents 1 and 2. 5.No prejudice would be caused to the official respondents if a direction is issued to respondents 1 and 2 to consider the petitioner's objections raised by him through his representation dated 23.02.2026 with regard to survey and demarcation of the boundaries made at the request of private respondents 4 and 5 before completing survey and demarcation of the boundaries of the property. 6.This Court is not expressing any opinion on the merits of the respective contentions.

7.For the foregoing reasons, this writ petition is disposed of by directing respondents 1 and 2 to give due consideration to the petitioner's representation dated 23.02.2026 raising objections for survey and demarcation of the boundaries of the property, morefully disclosed in the prayer to this writ petition, based on the request made by respondents 4 and 5 and only after due consideration to the same, respondents 1 and 2 shall decide whether to survey

the property, morefully disclosed in the prayer to this writ petition or not. No costs.
