This Criminal Original Petition has been filed to direct the respondent "Not to harass" the petitioner based on the petitioner representation dated 11.03.2023 and not to disturb the petitioner under the guise of enquiry.

2. It is the submission of the learned counsel for the petitioner that, petitioner borrowed money from the 2nd respondent and he paid bulk of the amount. There remains only small part of the amount to be paid. However, 1st respondent is unnecessarily harassing the petitioner.

3. In response, learned Government Advocate (Crl. Side) submitted that, 1st respondent is not harassing the petitioner. Infact, an order of attachment to compel the appearance of the petitioner was received from the learned 13th Metropolitan Magistrate, Calcutta and in order to effect the service of order, 1st respondent called the petitioner for appearance. There is no petition enquiry or FIR is pending before the 1st respondent.

4. In the light of the submission of the learned Government Advocate (Crl. Side), this Court is of the view that no order need to be passed in this petition.

5. Accordingly, this Criminal Original Petition is dismissed. However, this Court directs the petitioner to co-operate with the 1st respondent and receive the order of the 13th Metropolitan Magistrate Court, Calcutta. 17.03.2023 Internet : Yes / No Index : Yes / No Speaking / Non Speaking order Sma 3/4
