the third respondents to change the mutation of records relating to property situate at G.S.No.261/1 in T.S.No.10/1046 Krishnarayapuram Village, Balasundaram Road, Coimbatore within the City Municipal Corporation limits, measuring an extent of 7646 Sq.ft. in the name of the petitioner.

This writ petition has been filed seeking issuance of Writ of Certiorarified Mandamus to call for the Rectification Deed dated 22.02.2019 registered as Document No. 801/2019 in the Office of the Sub-Registrar of Registration, Peelamedu, Coimbatore and quash the same and consequently direct the third respondent to change the mutation of records relating to property situate at G.S.No.261/1 in T.S.No.10/1046 Krishnarayapuram Village, Balasundaram Road, Coimbatore within the City Municipal Corporation limits, measuring an extent of 7646 Sq.ft. in the name of the petitioner. 2.The learned counsel appearing for the petitioner submitted 2/4

that for the very same relief, the petitioner filed O.S.No.371 of 2019 on the file of the learned District Judge, Coimbatore and the same was dismissed for default. This Court may, without going into the merits of the case, close this writ petition by granting liberty to the petitioner to file restoration petition before the trial Court if not already filed and also permit the petitioner to canvass all the points before the civil Court where the civil suit is pending.
