O R D E R

Challenging the charge memo, dated 3.9.2013 issued by the second respondent, writ petition in W.P.No.26108 of 2003 has been filed wherein this Court on 24.4.2018 has recorded a statement of the learned counsel for the respondent that the charge memo ought to have been issued 1/3

invoking standing orders. Subsequently, the petitioner has made representation to settle the pensionery benefits.

2. The present contempt petition is filed by the petitioner on the allegation that the respondent has not passed an order cancelling the charge memo, dated 8.2.2002 which was still pending with the respondent. When the impugned charge memo is quashed, it is for the respondent to proceed further to initiate fresh proceedings. Therefore, cancellation of charge memo does not arise.

3. The learned Additional Advocate General appearing for the respondent also reiterated the same position that cancellation of charge memo may not arise for the reason that the charge memo already quashed by this Court.

4. In view of the above, contempt petition stands closed. No costs.
