Respondents Writ Petition is filed under Article 226 of the Constitution of India, for the issuance of Writ of Certiorari, calling for the records of the impugned order dated 27.05.2016 passed by the first respondent in Appeal No.CIC/VS/A/2013/001178/MP and quash the same as being arbitrary and violative of Section 19(4) of the RTI Act, 2005. O R D E R
The respective learned counsel appearing on behalf of the parties brought to the notice of this Court that judgment of the Hon'ble Supreme Court of India in the case of Reserve Bank of India vs. Jayantilal N.Mistry [(2016) 3 SCC 525] is now taken up for further review pursuant to the petitions filed by various Banks.
2. The matter has been referred to the Larger Bench and subjudiced. Thus the relief sought for by the Central Information Commission, which is impugned in the present writ petition cannot be complied with and more-so, the Banks are taking objections on furnishing 3/6
such informations to the individuals.
3. Thus, the order impugned passed in the present writ petition by the first respondent in Appeal No.CIC/VS/A/2013/001178/MP dated 27.05.2016 is kept in abeyance, till such time, the Hon'ble Supreme Court of India decides the issue, which is pending. Subject to the orders to be passed by the Hon'ble Supreme Court of India, the impugned order may be acted upon by the writ petitioner and the other respondents, as the case may be.
4. With the abovesaid observations, the writ petition stands disposed of. However, there shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
