The learned counsel for the applicant submitted that, before conducting the election, this application has been filed under Section 9 of the Arbitration and Conciliation Act, 1996 for direction against the respondent not to invoke particular clause in the notification of the election proceedings.

2. The learned counsel for the applicant would submit that the election has been conducted on 07.04.2024. Therefore, he submitted that the prayer in this application has become infructuous. Hence, he seeks leave of this Court to challenge the election proceedings.

3. Mr.A.Sam Praveen Kumar, learned counsel representing for Mr.R.Ganesh Ram, learned counsel appeared on behalf of the respondent also confirms the same.

4. Heard on both sides.

5. In view of the above submission made by the learned counsel for the applicant, the prayer in this application has become infructuous. It is made clear that it is for the applicant to challenge the method of conducting the election and this Court is not inclined to say anything about the election proceedings. Thus, the present application filed by the 1/3

applicant is dismissed. The right of the applicant is no way affected to challenge the election process.
