RESPONDENTS Writ petition is filed under Article 226 of the Constitution of India praying for a writ of mandamus to direct the respondents herein to consider and pass orders on the representations dt 24.12.2014 and 1.2.2015 submitted by the petitioner to permit her to work as Panchayat Assistant in the 3rd respondent Panchayat. O R D E R

With the consent of the learned counsel appearing on either side, the Writ Petition is taken up for final disposal at the admission stage itself.

2.The petitioner has filed this Writ Petition, seeking to consider the representations dated 24.12.2014 and 1.2.2015, to permit her to work as Panchayat Assistant in the third respondent Panchayat. 3.When Writ Petition came up for admission on 1.6.2015, this Court has passed the following order:

"The petitioner is a Village Assistant.

The grievance of the petitioner is that she is not https://hcservices.ecourts.gov.in/hcservices/

allowed to work after July 2014 and no written order was given to her.

Mr.Gunasekaran, learned Government Advocate seeks one week time.

Office is directed to print the name of the learned Government Advocate Mr.Gunasekaran and post on 08.06.2015 at the end of motion case."

4.Now a counter affidavit has been filed by the third respondent stating that the petitioner was not appointed as Panchayat Assistant in the third respondent Panchayat. Further, in the counter affidavit it has been stated that when a vacancy arose the Village Panchayat advertised the same on 06.06.2013 through 'Tom Tom' and affixed the notice on the Village Panchayat Office, inviting Applications from eligible persons to fill the vacancy of Village Secretary, five persons applied for the post, the appointment committee of the village Panchayat in its meeting held on 27.6.2013, selected one Mr.Iyappan son of Rangan, who was one among the five applicants and appointed him in the post and he is continuing as Secretary of the Village Panchayat. The said appointment was also approved by the District Collector by the proceedings in Na.Ka.No.116151/Pe2/2013, dated 25.7.2013. Hence, I find no merit in the Writ Petition. 5.Accordingly, the Writ Petition fails and the same is dismissed. No costs.
