The above applications have been filed for the following reliefs: Applications Relief sought for A.No.2103 of 2023 to condone the delay of 555 days in filing an application to set aside the abatement arising out of the death of the 2nd defendant.

A.No.2104 of 2023 to set aside the abatement arising out of the death of the 2nd defendant on 07.06.2021 A.No.2105 of 2023 to bring on record the legal heirs of the deceased 2nd defendant, namely the proposed respondents 5, 6 & 7 as defendants 5 to 7 in the suit.

2. Although notice has already been ordered, it is not complied. However, In order to avoid further delay and taking into consideration of the technicalities involved in impleading the legal heirs of the deceased second defendant, I feel these applications should be allowed and accordingly, these applications are allowed.
