ORDER

This Writ Petition (Criminal) has been filed seeking issuance of a direction to the respondents 1 and 2 to take immediate legal action against the respondents 5 and 6 under Section 4 of SC/ST (Prevention of Atrocities) Act, 1989 based on the petitioner's representation dated 08.01.2026 within a time frame to be fixed by this Court.

The petitioner submitted a representation on 08.12.2025 to the respondents, followed by another representation dated 08.01.2026. The primary contention of the petitioner is that his employer, DRA Projects Private Limited, was managed by one Nishanth Ranka, under whom the petitioner was employed as a site supervisor. Subsequently, DRA Projects Private Limited entered into a joint venture with Westbury Hospitality Private Limited. Thereafter, certain disputes arose between Nishanth Ranka and the Managing Directors of Westbury Hospitality Private Limited, namely Vipin Luthra and Abishek Luthra, resulting in dissolution of the business arrangement. According to the

petitioner, despite such dissolution, he continued in service as a site supervisor. During the said period, the petitioner alleges that he was subjected to insults and humiliation on account of his caste and social status. Hence, he submitted a representation dated 08.01.2026 seeking registration of a case against the alleged offenders under Sections18(A) and 3(1)(f), 3(1)(q), 3(1)(u), 3(1)(Za)(E), 3(2)(va), 3(2)(vii) of SC/ST (PoA) Act. As no action was taken, the present writ petition has been filed.

The learned Additional Public Prosecutor appearing for the respondents submitted that the dispute between Nishanth Ranka and the Managing Directors of Westbury Hospitality Private Limited, namely Vipin Luthra and Abishek Luthra is essentially a business dispute It is further submitted that the petitioner's sister is running a business entity in the name of M/s.Meteoroids Developers Private Limited and that the properties of the said company and Westbury Hospitality Private Limited are adjacent. It is stated that due to certain discrepancies in land records, including alleged preparation of incorrect field maps, a complaint was lodged by Shirish Bagga, Vice President of Westbury Hospitality Private Limited. Consequently, a case in Crime No.306 of 2025 dated 08.10.2025 has been registered for the offences punishable under Sections 191(2), 334(2), 296(b), 351(2) of BNS and Section 3 of Tamil Nadu Public Property (Prevention of Damage and Loss) Act. It is further submitted that the petitioner's present complaint has been duly

considered by the authorities an dupon enquiry, it was found that the same does not disclose any prima facie offence under the provisions of the SC/ST (PoA) Act. The complaint is stated to be a counterblast to the criminal case already registered against the petitioner.

Considering the submissions made and on perusal of the materials available on records, it is not in dispute that the petitioner is an accused in Crime No.306 of 2025 registered on 08.10.2025. It is also evident that there exists a business dispute between Westburry Hospitality Private Limited, Palm Paradise, M/s.Meteoroids Developers Private Limited and DRA Realty Private Limited, which is the subject matter of the said criminal case. The allegations relating to preparation of false documents and land disputes are already under investigation. Further, from the petitioner's representation dated 08.12.2025, there is no material to substantiate the allegation that the petitioner was abused by referring to his caste in a public place in public view. In such circumstances, the subsequent representation dated 08.01.2026 does not merit consideration. 5.
