O R D E R

The petitioner who is one of the prosecution witness in S.C.66 of 2017 on the file of the III Additional Sessions Court, Salem has approached this Court for a direction to the Court below to expedite the trial and complete it within reasonable time.

2. This Court after taking note of the fact that the case is of the year 2014 even after 10 years not yet reach the logical end. Hence, report from the trial Court was called.

3. The learned III Additional Sessions Judge, Salem in his report had stated that though the final report was filed in the year 2015 in P.R.C.No.9 of 2015, the same was taken cognizance in S.C.66 of 2017 and made over to the III Additional District Court, Salem. Thereafter, the accused persons one after another have approached the Court to quash the case and got interim relief of stay. Finally, the stay granted, got vacated by an order dated 10.11.2022.

4. When the matter was taken up for trial, A1 to A4 have filed 2/4

petition for discharge under Section 227 of Cr.P.C and the same is pending and therefore, had expressed difficulty in commencing the trial.

5. Taking note of the above facts and the dilated tactics adopted by the accused persons, filing petition after petition for quash one after another and now discharge petition, direct the trial Court to dispose of the discharge petition as early as possible and commence the trial and complete the same within a period of six months. No undue adjournments for cross examination witnesses to be granted. The trial must be conducted on day to day basis as far as possible.

6. With the above directions, this Criminal Original Petition is disposed of.
