PRAYER - This Writ Petition is filed under Article 226 of the Constitution of India, seeking a Writ of Mandamus, directing the Respondents 1 to 3 to consider and pass orders on the petitioners' representation dated 07.10.2025, within any prescribed period of time in accordance with law. This Writ Petition has been filed to direct the 2nd respondent to demolish the unauthorised construction put up by the 4th respondent based on the petitioner's representation dated 07.10.2025, within a time frame to be fixed by this Court.
2.According to the petitioners, they are occupants of the two row house. It is their case that the 4th respondent, who is also occupying one of the row house (Door No.16) is demolishing and reconstructing the said row house without obtaining planning permission. The petitioners have given a representation to the 2nd respondent on 07.10.2025, seeking to take action against the 4th respondent for the violation committed by him. Since the said representation was not considered, the petitioners have filed this Writ Petition. 3.Mr.Ravi Jayapal, learned counsel accepts notice on behalf of the 1st respondent, Mr.A.Arun Babu, learned counsel accepts notice on behalf of the
2nd respondent and Mr.Sanjay Balachandar, learned Standing Counsel for CMDA, accepts notice on behalf of the 3rd respondent. Since no adverse orders are passed against the 4th respondent, notice to the 4th respondent is dispensed with by this Court.
4.No prejudice would be caused to the respondents if the petitioners' representation as stated supra is considered on merits and in accordance with law, after hearing the objections of the 4th respondent, within a time frame to be fixed by this Court. This Court is not expressing any opinion on the merits of the petitioners' representation.
5.For the foregoing reasons, this Court directs the 2nd respondent to pass final orders on merits and in accordance with law on the petitioners' representation dated 07.10.2025, seeking to take action against the 4th respondent for demolishing and reconstructing the row house No.16, morefully disclosed in the representation after hearing the objections of the 4th respondent, within a period of twelve weeks from the date of receipt of a copy of this order. However, there shall be no order as to costs. Consequently, connected Miscellaneous Petitions are closed.
