The Oriental Insurance Co Ltd v. Raji(Decs)
C.M.P.Nos.2004, 2005 & 2006 of 2016 in CMA No.2544 of 2004 R.MAHADEVAN, J., CMP Nos.2004, 2005 and 2006 of 2016 have been filed seeking to: (i) condone the delay of 2219 days in filing the petition to set-aside the abatement caused due to the death of Raji / R-1;
(ii) set-aside the abatement caused due to the death of Raji / R-1 in CMA No.2544/2004; and (iii) bring the proposed respondents, as Legal Representatives of the deceased / R-1 - Raji and to implead them as R-3 to R-5 in CMA No.2544/2004.
2. The only contesting respondent, i.e., the claimant reported dead. Hence, the impleadment of LRs of the R-1 is a sine qua non.
3. Having regard to the reasons stated in the affidavits filed in support of the above petitions and being satisfied with the same, these petitions are ordered as prayed for.
