ORDER

The husband has moved a petition for divorce in H.M.O.P.No.40 of 2024 before the Family Court at Karur.

2. On being served with the summons, the wife has moved this transfer petition.

3. Mr.T.L.Thirumalaisamy, appearing on behalf of the petitioner states that the petitioner/wife is a permanent resident of Namakkal and therefore, she seeks transfer of the proceedings from Karur to Namakkal. She has also pleaded in her affidavit that she is finding it difficult to travel with her child, who is aged about two years.

4. Considering the fact that the wife finds it difficult to travel from Namakkal to Karur along with the child, I am inclined to allow this transfer petition. Hence, the proceedings in H.M.O.P.No.40 of 2024 which is now pending on the file of the Family Court at Karur is withdrawn and it shall stand transferred to the file of the Family Court at Namakkal.

5. It is made clear that the husband need not appear for every hearing. But he shall appear for the essential hearings. On all other hearings, he may be represented through a counsel.

6. Accordingly, the Transfer Civil Miscellaneous Petition stands allowed. No costs. Consequently, connected Civil Miscellaneous Petition is closed.
