This application has been filed seeking to set aside the order setting the defendants exparte. This order is dated 06.10.2023. Learned Single Judge had observed that the defendants had not filed their written statement and had therefore set them ex-parte. Along with this application, the 2nd defendant had filed written statement and 1st and 3rd defendants have filed a memo to adopt the said written statement.

In view of the bonafide expressed by the defendants and also since the learned counsel for the respondents/plaintiffs is absent today and even on 05.06.2024, even though time was granted for filing counter, in the interest of all the parties, holding that the issue is to be decided on merits, the application stands allowed.
