Crl.M.P.No.4241 of 2023 in Crl.O.P.No.32306 of 2022 A.D.JAGADISH CHANDIRA, J.

The present Criminal Miscellaneous Petition has been filed by the petitioner/Accused in S.T.C.No.565 of 2019 seeking extension of time granted by this court in Crl.O.P.No.32306 of 2023 by order dated 6.1.2023 for executing the sureties.

2. The petitioner was originally granted bail by the Sessions Judge, Udhagamandalam in Crl.M.P.No.900 of 2022 with a condition precedent, among other conditions, to deposit a sum of Rs.3,00,000/- before the Judicial Magistrate, Udhagamandalam, which came to be modified by this court as Rs.1,00,000/- by order dated 6.1.2023 in Crl.O.P.No.32306 of 2022 granting four weeks time from the date of receipt of that order to make such deposit.

3. Learned counsel for the petitioner would submit that the petitioner being a daily labour, is unable to mobilise the amount within the time stipulated by this court and thereby, he could not come out on bail by executing the sureties and hence, he craves indulgence of this court by granting some accommodation.
