ORDER

The present petition is filed seeking transfer of the decree passed in C.S.(Comm.Div)No.279 of 2023 on 18.04.2024 by this Court, to the District Court of Kancheepuram.

2. Learned counsel for the petitioner submitted that the property is situated at the jurisdiction of the Kancheepuram District and hence, the decree passed in C.S.(Comm.Div)No.279 of 2023 may be transmitted to the District Court, Kancheepuram, for execution.

3. Learned counsel for the respondent submitted that he has no objection for transfer of the decree to the Court sought for by the petitioner.

4. In view of the no objection given by the learned counsel for the respondent, E.P.No.52 of 2025 is ordered. The decree in 2/8

C.S.(Comm.Div)No.279 of 2023 is ordered to be transferred to the Kancheepuram District Court, as there is no Commercial Court @ Kancheepuram District.

At the instance of the learned counsel for the petitioner, the matter is listed today under the caption "for being mentioned".

2. This Court vide order dated 25.10.2025 allowed E.P.No.52 of 2025 and directed transfer of the decree to the Kancheepuram District Court for execution. Thereafter, the petitioner, when he came to know that there was no Commercial Court at Kancheepuram District, filed a memo dated 25.10.2025 seeking transfer of the decree to the Chengalpattu District Court (Commercial Division).

Today, learned counsel for the petitioner submits that a designated Commercial Court is functioning at Kancheepuram District Court and prayed for modification of the order dated 25.10.2025 and a direction for transfer of the decree to the Kancheepuram District Court (Commercial Division) for execution. He has filed an affidavit dated 11.11.2025 to that effect.

4. At this juncture, it is appropriate to consider Notification - VI mentioned in the G.O.(Ms)No.132, Home (Courts-II) Department, dated 17.03.2025 and the same is extracted hereunder: NOTIFICATION -VI.

In exercise of the powers conferred by section 3A of the Commercial Courts Act, 2015 (Central Act 4 of 2016) the Governor of Tamil Nadu, after consultation with the High Court of Madras, hereby makes the following amendment to the Home Department Notification No.II(2)/HO/891/2021, published at page 513 of Part II Section 2 of the Tamil Nadu Government Gazette, published in Issue No.51, dated the 22nd December, 2021, namely:- AMENDMENT In the said Notification, for the expression "Kancheepuram at Chengalpattu", the expression "Chengalpattu" shall be substituted.

5. In view of the above Government Order, the Commercial Court at Chengalpattu is the appropriate Court. The same is recorded. The Registry is directed to issue fresh order copy after carrying out the following 6/8

correction in paragraph 4 of the order dated 25.10.2025 in E.P.No.52 of 2025:

"4. In view of the no objection given by the learned counsel for the respondent, E.P.No.52 of 2025 is ordered. The decree in C.S.(Comm.Div)No.279 of 2023 is ordered to be transferred to the Commercial Court at Chengalpattu."
