PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C., to call for the records relating to the FIR in Crime No.8/AC/2008, C.C.V, dated 19.12.2008, on the file of the respondent police.

ORDER

This Criminal Original Petition has been filed seeking to quash the F.I.R in Crime No.8/AC/2008.CC.V dated 19.12.2008, pending on the file of the respondent police. 2.

The case of the prosecution is that while the petitioner was working as a packer in the LPG Indane Gas wing, a surprise inspection was jointly undertaken by the Vigilance and Anti Corruption Wing along with the District Inspection Cell, Collectorate, Chennai on 19.12.2008. An FIR came to be registered in Crime No.8/AC/2008-CCV. Charge Memo was issued with regard to seizure of unaccounted cash of Rs.4,210/- in the Table Drawer. Enquiry was conducted and based on the enquiry report, the Disciplinary authority imposed a penalty of stoppage of increment for 6 years and 5 months. imposed by the Department was completed and the petitioner was already retired from service on 30.06.2020, the petitioner filed this Criminal original petition seeking to quash the FIR. 3.

The learned counsel for the petitioner submitted that the similarly placed persons like that of the petitioner had approached this Court and obtained an order in Crl.OP No.11800 of 2019 & 11823 of 2019 .

The learned Additional Public prosecutor on instructions submitted that the matter has been investigated and closed on 12.08.2011.

Recording the submission of the learned Additional Public Prosecutor, nothing survives in this petition and accordingly, this Criminal Original petition is dismissed as infructuous.
