O R D E R

The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Sections 316(2) and 318(2) of BNS, 2023 in Crime No.62 of 2026, on the file of the respondent Police, seeks anticipatory bail.

2. The allegation against the petitioner is that the petitioner entered into rental agreement with defacto complainant on rental business and subsequently nor paid the rent nor returned the car. Hence, the case was registered.

3. The learned counsel for the petitioner submitted that one of the customer had taken the car for higher price and he removed GPS and taken away and hence he was not able to return the car. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) reiterated the prosecution case and submitted that the petitioner has taken away the car 2/5

which was valued Rs.10 lakhs. He further submitted that, apart from this complaint, 10 other complaints also been lodged against this petitioner and the same has been pending enquiry for CSR. Hence, he opposed for grant of anticipatory bail to the petitioner.

5.Considering the nature of allegations and the fact that the car is not yet recovered, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 27.02.2026 sma 3/5
