ORDER

The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 296(b), 115(2), 118(1), 191(1), 126(2), 109 of BNS in Crime No.51 of 2026 on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that due to a pathway dispute, the petitioners abused the defacto complainant with filthy language and assaulted him with an iron rod, causing grievous injuries to him. Hence, the complaint.

The learned counsel for the petitioners submitted that there was an altercation in connection with a land dispute and that, during the course of the incident, the third accused accidentally kicked the injured/de facto complainant. He further submitted that the petitioners are ready to abide by any conditions that may be imposed by this Court. Hence, he prayed for anticipatory bail for the petitioners.

However, the learned Government Advocate (Criminal Side) strongly opposed the bail application on the ground that the injured sustained grievous injuries and was hospitalized from 08.02.2026 to 01.03.2026. It was further submitted that even now, he has been referred to another hospital for further treatment. Hence, he strongly opposed the grant of anticipatory bail.

5. Heard the learned counsel for the petitioners and the learned Government Advocate (Crl. Side) for the respondent.

Considering the gravity of the injuries sustained by the injured/de facto complainant, this Court is of the view that if the petitioner is enlarged on anticipatory bail, it would have a negative impact on the locality and may create law and order issues. Therefore, this Court is not inclined to grant anticipatory

bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed. Consequently, connected miscellaneous petition is closed. 17-03-2026 MPA To 1.The Inspector of Police, Athiyamankottai Police Station, Dharmapuri - 636 807.
