Respondent/Complainant PRAYER: Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure, to direct the Fast track Mahila Court, Namakkal to rely only on the documents already furnished to the accused under Section 207 of Cr.P.C in S.C.84 of 2018 and not to permit the prosecution to introduce any extraneous documents thereto without following the procedure established under law.

O R D E R

This Criminal Original Petition has been filed seeking for a direction to the Fast track Mahila Court, Namakkal to rely only on the documents already furnished to the accused under Section 207 of Cr.P.C in S.C.84 of 2018.

2.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the respondent.

3. It is seen that, at the time of furnishing the copies to the accused, the documents which are related to the prosecution case are not furnished to the petitioner as contemplated under Section 207 of Cr.P.C. Further, it is also seen that while, the https://hcservices.ecourts.gov.in/hcservices/

prosecution examined PW1 and marked certain documents, which are not furnished to the petitioner at the time of furnishing copies.

4. Considering the above facts and circumstances of the case, the respondent is directed to furnish the copies which are intended to mark through PW1 during the trial, to the petitioner. After serving copies, the trial Court is directed to proceed with the trial.

5.With the above direction this Criminal Original Petition stands disposed of. After serving the documents to the petitioner, he may be directed to cross examine PW1. Consequently, connected miscellaneous petition is closed.
