This Criminal Original Petition has been filed seeking to enlarge the petitioners on bail in S.C.No.161 of 2022 on the file of the learned Sub Court, Ulundurpet, in Crime No.151 of 2014 registered for the offence punishable under Sections 147, 148, 294(b), 324, 506(ii) and 307 of IPC on the file of the respondent Police.
2. The learned counsel for the petitioners would submit that the petitioners who are arrayed as A10 and A13 are facing trial in S.C.No.161 of 2022 pending on the file of the learned Sub Court, Ulundurpet. He would further submit that the case is of the year 2014 and the petitioners have been all along regularly appearing before the Court and they were unable to appear before the Court on 23.02.2023 and thereby, the learned trial Judge has issued a Non Bailable Warrant of arrest. Therefore, he prays for grant of bail to the petitioners.

mpa appearing before the Court. However, he would submit that Non Bailable Warrant of arrest has been issued and in such circumstances, the option available to the petitioner is to surrender before the concerned Court and file petition seeking for Non Bailable Warrant and it is for the Court to decide the same.

In view of the above, a direction is issued to the petitioners to surrender before the concerned Court and file an application for recalling the Warrant and the learned Trial Judge shall consider the same and pass order on the same day of surrender taking into consideration the merits of the case.
5.Accordingly, this Criminal Original Petition stands disposed of.
