2. The applicant states that the suit summons received from the court was not communicated to the counsel and, therefore, the delay has occurred.

3. The respondent/plaintiff has no objection to this application being allowed.

4. Upon examining the affidavit in support of the application and being satisfied that sufficient cause is made out, this application is allowed and the delay is condoned.
