Application No.2259 of 2020 has been filed seeking to condone the delay of 21 days in filing the written statement containing the counter claim on behalf of the third defendant. It had been stated that the suit summons was received on 24.01.2020 and the written statement along with the counter claim should have been filed on or before 23.02.2020. It had been stated that there was some delay in collecting material documents for filing the written statement and also for the counter claim. 2.In view of these facts, there has been a delay of 21 days in filing. 3.Heard the learned counsel for the respondent/plaintiff also. 4.In view of the fact that since counter claim has been filed and the respondent/plaintiff would have an opportunity to file a reply statement, and also since it would be an advantages to both the sides that if the issues raised in the plaint are decided on merits, the delay is condoned and the written statement with the counter claim is taken on file.
