The petitioner has come up with the present writ petition for a writ of mandamus directing the respondent herein to forthwith consider and pass orders on the Application of the petitioner dated 29.04.2015 seeking grant of No Objection Certificate to enable the Institution of the petitioner namely "Sri Vidya College of Education, No.22, P.Kumaralingapuram Village, Virudhunagar-626 005" to submit application for starting M.Ed. Course for the academic year 2016-2017 to the National Council for Teacher Education.
2. The case of the petitioner is that the petitioner is a Trust. After obtaining necessary approval/permission from the competent authorities, the petitioner Trust has established and is running the Educational Institutions. As on today, about 3000 students are studying and about 300 teaching and non-teaching staff members are working in the Educational Institutions of the petitioner Trust. The petitioner Trust is going to start a new course viz., M.Ed. Course, for which, they need No Objection Certificate. Hence, the petitioner Trust has submitted an application dated 29.04.2015 before the respondent University for the grant of No Objection Certificate. Along with the application dated 29.04.2015, the petitioner submitted copies of approvals, extension of approvals, affiliations, extension of affiliations, certificate of accreditation etc., and requested the university to grant No Objection Certificate. But the said application was not considered so far. The last date for submission of application for starting M.Ed. Course before National Council for Teacher Education is 31.05.2015.
Therefore, it is necessary to obtain No Objection Certificate from the respondent University immediately. Since the petitioner's application was not considered by the respondent University, the petitioner has come forward with the present writ petition.
3. Heard the learned counsel appearing on either side and perused the materials available on record.
4. This Court, taking into consideration the limited scope of prayer sought for by the petitioner and without going into the merits and demerits of the case, directs the respondent to consider the application of the petitioner dated 29.04.2015 for issuance of No Objection Certificate for starting new Course viz., M.Ed. Course, and to pass appropriate orders on merits and in accordance with law, on or before 25.05.2015. 5.
This Writ Petition is disposed of accordingly. No costs.
