PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C., to transfer the investigation from the 2nd respondent concerned in Crime No.61 of 2019 to that of any other investigating agency.

ORDER

This petition has been filed seeking direction to transfer the investigation in Crime No.61 of 2019 from the 2nd respondent to any other investigating agency.

2.The learned counsel for the petitioner would submit due to previous enmity, the accused persons along with henchmen assaulted the petitioner, thereby sustained bleeding injuries. He further submitted that the 2nd respondent coming to know about the incident and recorded the statement and registered an F.I.R in Crime No.61 of 2019 for the offences under Sections 147, 294 (b), 323, 324, 435 and 506(ii) of IPC. The 2nd respondent instead of registering the case against the above said persons had hand in glove with the accused persons and kept the investigation pending.

3.In view of the above, the petitioner is directed to submit a fresh representation in respect of Crime No.61 of 2019 to the respondent. On receipt of the same, the 2nd respondent is directed to consider the petitioner's representation and conduct proper enquiry and file a final report within a period of three months from the date of receipt of a copy of this order. 4.With the above said direction, the Criminal Original Petition is Disposed of.
