This writ petition has been filed seeking issuance of a writ of mandamus directing the third respondent to issue patta in the name of the petitioner and his siblings by considering the representations dated 14.10.2009 and 24.05.2022 after re-classification of the land, within the time frame fixed by this Court.
2. Heard Mr.P.Dinesh Kumar, learned counsel for petitioner and Mr.P.Sathish, learned Additional Government Pleader appearing for respondents.
3. There are two grievances expressed by the petitioner. The first grievance is that there is a wrong classification of the land as Government poramboke and several representations have been sent in 2/4
this regard by the father of the petitioner to the third respondent. Thereafter, representations were also sent by the petitioner and his siblings and the same did not evoke any response. Yet another grievance that has been expressed is that the petitioner has sought for issuance of patta and the same was also not considered.
4. In the considered view of this Court, until and unless the reclassification is done, there is no scope for issuance of patta in the name of the petitioner and his siblings. In view of the same, there shall be a direction to the petitioner to make a fresh representation to the second respondent with all the relevant documents and also a copy of this order. On receipt of the same, the second respondent shall conduct enquiry and take a decision with respect to the reclassification of the subject land sought for by the petitioner and his siblings. Necessary orders shall be passed within a period of twelve (12) weeks from the date of representation from the petitioner. Depending upon the final decision taken by the second respondent, the petitioner can thereafter seek for issuance of patta.
