This petition is listed today under the caption 'for being mentioned' at the instance of the learned counsel on either side.

2. It is the contention of the learned counsel for the respondent that while disposing of the petition, this Court permitted the respondent to withdraw the amount and the same has not been reflected in the order dated 06.08.2025. The learned senior counsel for the petitioner submits that though the respondent may withdraw the amount, but that may not amount to admitting the relationship and the fact of disputed relationship ought to be decided in the pending trial.

3. Considering the submissions on either side, this Court is inclined to add the following at the End of Paragraph No.18 of the order dated 06.08.2025. "At this stage, the learned counsel for the respondent seeks permission of this Court to withdraw the amount deposited by the petitioner, acceding to the said request, the respondent is permitted to withdraw the amount lying in the credit of DVC proceedings by filing appropriate application before the concerned court, however, it is made clear that mere withdrawal of the amount does not amount to admitting the relationship and the fact of disputed relationship ought to be decided in the pending trial." 1/3

4. Registry is directed to incorporate the same and issue a fresh order copy. Further, Registry is also directed to incorporate the designation of petitioner's counsel as 'Senior counsel' in the appearance portion. This petition is clarified accordingly.
